Osage County had a "stand your ground" aka "Make My Day" fatal shooting this morning. Homeowner found two men allegedly breaking into his garage and stealing tools, investigators said. The homeowner approached, the two men backed a truck at him, and the homeowner shot at them. One died of a single gunshot wound, the other ran, was subsequently apprehended and is jailed. Homeowner is not charged. According to the Sheriff's Office, dead is Steven Baker, 22, of Skiatook. Another man, Harley Eschbach. was jailed this afternoon on pending charges of 2nd degree burglary and 1st degree murder (in commission of a felony, i.e. the burglary). Shooting occurred around 4:15 a.m. on N 36 W Ave. Details unavailable at the moment: Investigation is continuing.
This could of been avoided. Firring a gun ininto a vehicle why do we have the police. When a vigalante can judt take. Matters in his. Own hands take a life and for what some tools.its to the point now shoot first then ask questions. Then Cal. The police last tools for a life doesn't. Weigh out if it was my son loosing some tools. Would. Be nothing. Just curious was u deaf dumb and was definitely stupid next time don't be so quick. For a shootout (over tools ) want to police.

I'm sorry but i'm for the "Make my day law" I live in the country and if someone comes on my property to harm or steal I won't have time for the police I will protect my family and property! It is VERY UNFORTUNATE and my thoughts and prayers are with all the families involved. And i'm sure the homeowner is very sorry for what happened but these boys should have been in bed or working for what they want not stealing it.

I hope this "man" that shot to kill before calling the police is arrested and convicted for the MURDER of this young man! Are your petty tools worth the life of another person? I hope this makes some changes to this ridiculous law. It's one thing to shoot to injure someone or in full self defence but this story just doesn't seem to fit. I hope this "man" sees this boys face every night for the remainder of his pitiful life. Nothing is worth taking someones life unless it's your life.

"Property Preservation" you must have missed where it says they were backing the truck up towards the property owner and he fired in response. There's no such thing as "shooting to injure" with a gun, especially when outlaws are trying to run you down on your own property.

If you don't want to get shot, don't steal from others and then try to run them over. Good for the homeowner. I would have done the same.
